The Uniform State Test (UST): what it is and how to pass it

The UST is the state-law part of the SAFE MLO exam: who needs a license, how you get and keep it, and what regulators can do. It is the smallest part of the test and the most factual. You either know the numbers or you do not. This page covers everything in it, free and open to everyone.

Checked against the NMLS content outline, the SAFE Act, the CSBS/AARMR Model State Law and NMLS licensing guides on 5 November 2026. General information, not legal advice. Your state's regulator and NMLS are the authority.

The UST at a glance

One test, every state

The UST is part of the SAFE MLO National Test with Uniform State Content: 120 questions, 115 scored, at least 75% to pass. Uniform State Content is 11% of it, about 13 scored questions. There is no separate New York test.

Where the questions come from

The SAFE Act (2008) and the CSBS/AARMR Model State Law, which states used to write their own SAFE Act laws. The NMLS outline groups the content into the SAFE Act, state regulators and NMLS, license law, and compliance.

Questions about the UST

What is the Uniform State Test (UST)?

The UST is the state-law part of the SAFE MLO exam. Its full name is the Uniform State Content. It tests the licensing and conduct rules that states adopted from the SAFE Act and the CSBS/AARMR Model State Law, so the same questions apply in every state that adopted it.

Is the UST a separate exam?

No. It is built into one test, the SAFE MLO National Test with Uniform State Content. You take it once and it counts for every state that adopted the UST. New York adopted it in 2014, so there is no separate New York test.

How many UST questions are on the exam?

The test has 120 questions: 115 scored and 5 unscored. Uniform State Content is 11% of the test, which works out to about 13 of the 115 scored questions.

What score do I need on the UST part?

There is no separate UST passing score. You need at least 75% correct on the whole test.

What does the UST cover?

Four areas from the NMLS content outline: the SAFE Act; the powers of state mortgage regulators and NMLS; license law (who needs a license, qualifications, education, testing, renewal, temporary authority); and compliance (examinations, prohibited acts, record keeping, advertising with your NMLS ID).

Which numbers should I memorize?

20 hours of pre-licensing education (3 federal law, 3 ethics, 2 nontraditional lending). 8 hours of continuing education every year (3 federal law, 2 ethics, 2 nontraditional lending). 75% to pass. 30 days between retakes, 6 months after three failures in a row. No felony in the 7 years before applying, and never a felony involving fraud, dishonesty, breach of trust or money laundering. Retake the test after 5 years without a license. Renewal November 1 to December 31; reinstatement January 1 to the end of February. Temporary authority up to 120 days. Up to $25,000 per violation.

Who has to be licensed, and who is exempt?

Anyone who, for pay, takes a residential mortgage application or offers or negotiates its terms needs a license, unless they are a registered MLO at a bank or credit union. The model law exempts helping an immediate family member, financing the sale of your own home, and an attorney negotiating for a client as part of the representation (unless paid by a lender or broker). An employee processor working under a licensed MLO does not need a license; an independent contractor processor does.

What is temporary authority?

It lets a qualified MLO originate loans for up to 120 days while a new state license application is pending. It covers an MLO leaving a bank who was registered in NMLS for the year before applying, and an MLO licensed in another state for the 30 days before applying. The MLO must work for a state-licensed mortgage company, and anyone with a revoked license or a cease and desist order is not eligible.

Are the UST rules the same in New York?

The UST content is the same everywhere. A state can add its own requirements on top of it. New York requires 3 hours of New York law within the 20 pre-licensing hours, and 11 hours of continuing education a year: the 8 national hours plus 3 hours of New York law.

Is the exam offered in Spanish?

No. The SAFE MLO test is given in English, which is why the MLO section of this site is in English.
